Services for Scottish Executries
Support for Scottish executry administration
What we do
Administering an executry in Scotland brings its own legal requirements and processes. You may need to confirm Legal Rights or secure a Bond of Caution before the executry can be distributed.
Title Research supports you with both. We help you understand entitlement under Scottish law and ensure you meet the requirements to move the executry forward.
Legal Rights Checker
In Scotland, certain relatives can claim Legal Rights from an executry, even when there is a Will.
These rights apply to:
Spouses or civil partners
Children of the deceased
Understanding who can claim, and what they may be entitled to, is essential before distributing the executry. We can help you:
Identify individuals with Legal Rights
Confirm family relationships
Assess potential claims
Provide clear evidence to support your position
This gives you clarity on entitlement and helps you manage the executry with confidence.
Bond of Caution
If there is no Will, or no Executor able to act, the Court may require a Bond of Caution before granting Confirmation (the Scottish equivalent of Letters of Administration). You will need a Bond of Caution for all executries where an Executor has not been appointed via a Will, unless:
A spouse or civil partner is inheriting the entire executry, or;
The executry is less than £36,000 in value
A Bond of Caution protects beneficiaries and creditors by providing financial security if the executry is not administered correctly. Title Research can help you secure a Bond of Caution quickly and efficiently. We will:
Assess whether a Bond of Caution is required
Guide you through the application process
Guide you through the application process

Why Scottish estates can be more complex
Scottish estate administration differs from England and Wales in several key ways.
These include:
Legal Rights claims overriding parts of a Will
Different Court processes and terminology
Specific requirements, such as a Bond of Caution
Without the right support, these differences can lead to delays or uncertainty. We help you navigate these requirements clearly and efficiently.
Case Studies
Discovering estranged children
Our client was administering an executry where the residue had been left to a charity, along with specific gifts to cousins.
During the process, conflicting information emerged. Some Legatees suggested the deceased may have had an estranged daughter who could be entitled to claim Legal Rights.
We carried out detailed checks to establish the position. Our research confirmed that the deceased had two children, a son and a daughter.
Following this, we were instructed on a fixed-fee basis to trace and locate both individuals. This allowed the Solicitor to contact them and address their potential Legal Rights claims before progressing with the estate.
Confirming no Legal Rights claimants exist
A Solicitor acting as Executor instructed us to check whether any Legal Rights claimants existed.
As they had no direct connection to the family, they wanted reassurance before distributing the estate.
We carried out targeted research to assess whether any individuals could bring Legal Rights claim. Our findings confirmed that no such claimants existed.
With this clarity in place, the Executor was able to move forward confidently. They also chose to take out a cost-effective insurance policy for additional peace of mind before distribution.
