Bond of Caution

If there is no Will, or no Executor able to act, the Court may require a Bond of Caution before granting Confirmation (the Scottish equivalent of Letters of Administration). You will need a Bond of Caution for all executries where an Executor has not been appointed via a Will, unless:

  • A spouse or civil partner is inheriting the entire executry, or;

  • The executry is less than £36,000 in value

Case Studies

Discovering estranged children

Our client was administering an executry where the residue had been left to a charity, along with specific gifts to cousins.

During the process, conflicting information emerged. Some Legatees suggested the deceased may have had an estranged daughter who could be entitled to claim Legal Rights.
